1. About Breathe Be Gone

Breathe Be Gone is a utility app designed to help users reduce or remove distracting breathing sounds and other unwanted noise from video or audio files. The App may allow users to import media, process or preview cleaned results, and export processed files after purchasing access through a subscription or export credits.

Breathe Be Gone is intended as a convenience tool. Results may vary depending on the quality of the original recording, background noise, voice levels, file format, device performance, and other factors.

2. Eligibility

You must be at least 13 years old, or the minimum age required in your jurisdiction, to use Breathe Be Gone. If you use the App on behalf of a company, organization, or other entity, you represent that you have authority to accept these Terms on its behalf.

3. Purchases, Subscriptions, and Export Credits

Breathe Be Gone may offer paid access through auto-renewable subscriptions, one-time purchases, export credit packs, or other in-app purchases.

Subscriptions may include monthly or yearly access to premium features, including the ability to export processed files. Subscriptions automatically renew unless canceled through your Apple account settings before the renewal date.

Export credits, if offered, allow you to complete a limited number of successful exports. Unless otherwise stated in the App, one export credit equals one successful completed export. Credits are consumed only when an export is successfully completed. Previewing, importing, or processing a file does not necessarily consume a credit unless clearly stated in the App.

Prices, features, and purchase options may change over time. Any available purchase options will be shown in the App before you complete a purchase.

4. App Store Payments and Refunds

All purchases made through the iOS App are processed by Apple through the App Store. We do not directly process your App Store payment information.

Subscription cancellation, refund requests, billing issues, and purchase management are handled through Apple according to Apple's policies. We do not control Apple's refund decisions.

You can manage or cancel subscriptions through your Apple ID account settings.

5. No Free Exports

Breathe Be Gone may allow you to preview processed audio or video before purchasing. However, exporting processed files may require an active subscription, available export credits, or another paid unlock.

Preview access does not guarantee free export access.

6. User Content

You retain ownership of the audio, video, images, files, and other content you import into Breathe Be Gone ("User Content").

By using the App, you grant us a limited license to process your User Content solely for the purpose of providing the App's features, such as noise reduction, preview generation, export creation, troubleshooting, security, and service improvement.

You are responsible for ensuring that you have the rights and permissions necessary to upload, process, edit, and export any User Content you use with the App.

You agree not to use Breathe Be Gone to process, upload, create, or distribute content that violates the rights of others, violates any law, or contains unlawful, harmful, abusive, defamatory, obscene, or otherwise objectionable material.

7. Processing and Output Quality

Breathe Be Gone uses automated tools and audio processing techniques to reduce unwanted breathing sounds and noise. We do not guarantee that all breathing sounds, background noise, distortion, or unwanted audio will be fully removed.

The quality of output depends on many factors, including the original recording, speaker volume, microphone quality, overlapping sounds, background audio, compression, file format, and processing limitations.

You are responsible for reviewing any processed file before publishing, sharing, or relying on it.

8. Acceptable Use

You agree not to:

• Reverse engineer, copy, modify, or attempt to extract the source code of the App.
• Interfere with, disrupt, overload, or abuse the App or related systems.
• Attempt to bypass payment, export restrictions, subscriptions, credits, or entitlement checks.
• Use the App for unlawful, infringing, harmful, or deceptive purposes.
• Upload or process content you do not have the right to use.
• Use automated tools, bots, or scripts to misuse the App.
• Resell, sublicense, or commercially exploit the App except as permitted by these Terms.

9. Intellectual Property

Breathe Be Gone, including its name, branding, design, features, software, interface, logos, graphics, and related content, is owned by Breathe Be Gone or its licensors and is protected by intellectual property laws.

These Terms do not grant you ownership of the App or any related intellectual property. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal or lawful business use in accordance with these Terms.

10. Third-Party Services

The App may rely on third-party services, frameworks, cloud providers, analytics tools, crash reporting tools, payment systems, or processing providers. Your use of the App may also be subject to third-party terms and privacy policies.

We are not responsible for third-party services that we do not control.

11. Updates and Changes to the App

We may update, modify, suspend, or discontinue any part of the App at any time. Features, pricing, subscriptions, credit packs, processing limits, supported formats, and availability may change.

We may release updates to improve performance, security, compatibility, or functionality. Some features may require the latest version of the App.

12. Termination

We may suspend or terminate your access to the App if we believe you violated these Terms, misused the App, attempted to bypass payment restrictions, caused harm to the Service, or used the App unlawfully.

You may stop using the App at any time. Deleting the App does not automatically cancel an active subscription. Subscriptions must be canceled through your Apple account settings.

13. Disclaimers

Breathe Be Gone is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.

We do not guarantee that the App will be uninterrupted, error-free, secure, or produce perfect results. We do not guarantee that any processed file will meet your expectations or be suitable for a specific use.

14. Limitation of Liability

To the maximum extent permitted by law, Breathe Be Gone, its owners, employees, contractors, affiliates, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, lost content, business interruption, or reputational harm arising from your use of the App.

Our total liability for any claim related to the App will not exceed the amount you paid for the App or Service during the twelve months before the claim arose, or $50, whichever is greater.

15. Indemnification

You agree to defend, indemnify, and hold harmless Breathe Be Gone, its owners, employees, contractors, affiliates, and service providers from any claims, damages, liabilities, losses, costs, or expenses arising from your use of the App, your User Content, your violation of these Terms, or your violation of any law or third-party rights.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may notify you through the App or by other reasonable means. The updated Terms will be effective as of the date posted.

Your continued use of the App after changes become effective means you accept the updated Terms.

17. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
